Section 133 of the Criminal Justice Act 1998 applicable in England, Wales, Scotland and Northern Ireland provides compensation for miscarriages of justice. The Department for Work and Pensions will now indefinitely disregard these compensation payments when assessing means-tested benefits in Great Britain.
This Statutory Rule ensures that Northern Ireland maintains parity with Great Britain and that those recipients of a compensation payment continue to receive their entitlement to means-tested benefits.
