The Department has published its response to the consultation on Section 167 of the Charities Act (Northern Ireland) 2008. The consultation ran from 17 September to 1 October 2025, during which stakeholders were invited to provide views on whether this uncommenced provision relating to charities established outside Northern Ireland but operating for charitable purposes in or from Northern Ireland should be amended and commenced.
Following analysis of the feedback received, the Department has concluded that Section 167 should be repealed, as it is inoperable in its current form and would create unnecessary duplication and administrative burden. Repeal will ensure clarity for charities and the public and allow organisations established elsewhere to continue operating in Northern Ireland without additional bureaucracy.
