    The Department for Communities will mirror the approach published today by the Department for Work and Pensions and will be implementing the Supreme Court Judgement known as MM from 17 September 2020 on all PIP claims assessed on or after this date.

    The decision in this case provided further clarity on the definition of “social support”, when engaging with other people face to face, in Activity 9 of the Personal Independence Payment (PIP) Regulations, and how far in advance that support can be provided.

    The Department will be undertaking an administrative exercise in due course to check whether claimants are entitled to more PIP as a result of this judgment. Anyone whose PIP award is to change will receive payments backdated to the effective date in each individual case. They will be contacted directly and there is no need for people to actively contact the Department.
