The Universal Credit (Earned Income) (Amendment) Regulations (Northern Ireland) 2020 amend the Universal Credit Regulations (Northern Ireland) 2016 to give effect to the Court of Appeal judgment in Great Britain which found that the Secretary of State for Work and Pensions acted irrationally by failing to adapt the earned income assessment rules in Universal Credit (UC). These Regulations provide a remedy to the Court of Appeal Judgment where a person may have two sets of calendar monthly earnings from the same employer taken into account in the same UC assessment period and may lose out on the benefit of a work allowance, and makes provision for the way information, in particular information reported to HMRC by Real Time Information Employers, is to be used in calculating a person’s earned income.
